Our Commitment to Your Privacy

Andrew Barnett MD PC is required by law to maintain the privacy of your protected health information (“PHI”), to provide you with this Notice of our legal duties and privacy practices, and to notify you following a breach of unsecured PHI. We are required to abide by the terms of this Notice currently in effect.

How We May Use and Disclose Your Health Information

For Treatment. We may use and disclose your PHI to provide, coordinate, or manage your care and related services, including consultations with other healthcare providers involved in your treatment.

For Payment. We may use and disclose your PHI to obtain payment for services we provide to you, including billing and collections activities, and communications with your insurance company, if applicable.

For Healthcare Operations. We may use and disclose your PHI for our practice’s operations, including quality assessment, staff training, licensing, and business management activities.

Appointment Reminders. We may use and disclose your PHI to contact you with appointment reminders and confirmations, by phone, email, or SMS text message (if you have opted in to SMS communications).

As Required by Law. We will disclose your PHI when required to do so by federal, state, or local law.

To Avert a Serious Threat to Health or Safety. We may use and disclose your PHI to prevent a serious threat to your health and safety or the health and safety of the public.

Business Associates. We may disclose your PHI to third-party “business associates” that perform functions on our behalf (such as billing, scheduling, or SMS/communications services), provided they agree to protect the information as required by HIPAA.

Public Health, Health Oversight, and Legal Proceedings. We may disclose PHI for public health activities, health oversight activities, judicial and administrative proceedings, and law enforcement purposes, as permitted or required by law.

Uses and Disclosures Requiring Your Written Authorization

Marketing and Photography. We will not use your photographs, before/after images, or other identifiable information for marketing, advertising, or promotional purposes without your separate written authorization. You may revoke this authorization at any time, except to the extent we have already relied on it.

Other Uses. Other uses and disclosures not described in this Notice will be made only with your written authorization, which you may revoke at any time in writing.

Your Rights Regarding Your Health Information

You have the right to:

  • Inspect and copy your PHI maintained in our records
  • Request an amendment to your PHI if you believe it is incorrect or incomplete
  • Request an accounting of disclosures of your PHI made by our practice for purposes other than treatment, payment, and healthcare operations
  • Request restrictions on certain uses and disclosures of your PHI, though we are not required to agree to all requests
  • Request confidential communications — for example, that we contact you at a specific phone number or address
  • Obtain a paper copy of this Notice at any time, even if you have agreed to receive it electronically
  • Be notified of a breach of your unsecured PHI, as required by law

Our Responsibilities

We are required to maintain the privacy of your PHI, provide you with this Notice, abide by its terms, notify you if we are unable to agree to a requested restriction, and notify you of any breach of unsecured PHI.

Changes to This Notice

We reserve the right to change this Notice and to make the revised or changed Notice effective for PHI we already have as well as any information we receive in the future. We will post a copy of the current Notice in our offices and on our website, www.drbarnett.com.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer or with the U.S. Department of Health and Human Services, Office for Civil Rights. You will not be retaliated against for filing a complaint.
